Derrick Hamilton is innocent, yet has been wrongly imprisoned for the last 19 years for the tragic shooting death of Nathaniel Cash, which occurred on January 4th 1991 at 215 Monroe St., Brooklyn, N.Y. at approximately 11:00 am. Derrick needs your help!
Overwhelming evidence was presented to the Kings County Court to show Derrick was in New Haven, connetticut, which is 1 hour and 53 minutes away from Brooklyn, where the murder occured. Police documents and reliable evidence demonstrate that Hamilton has been wrongly convicted. The jury that convicted Derrick believed witness #1 witnessed the crime. As witness #1 was the sole person called by the prosecutor. Under extensive cross examination witness #1 admitted she committed crimes and lied to law enforcement when it served her purpose, but swore her trial identification that Derrick committed the crime was true. Based on witness #1 's sole trial testimony Derrick was found guilty of intentional murder in the second degree on July 17th, 1992.
Prior to sentencing, Derrick learned that witness #1 had told a Detective at the crime scene she did not witness the crime. A fact that was never disclosed to the jury, who was told that witness #1's first statement at the scene was "Derrick killed Nate". Based on the Detectives' memo book entry, Derrick moved for the verdict to be set aside. The trial Judge held hearings and made the following statements (amongst other things) on the court record:
The case against Derrick was tried and won on the fact that witness #1 testified. She was the only witness the people had.
The jury never heard the Detectives' memo book entry statement about witness #1 was in fact not a witness and didn't see it happen.
If the prosecutor does not call witness #1 back before the court, in all probability a new trial would be held.
The witness #1 crime scene declaration to the Detective by itself is something that should have set aside the verdict.
The witness #1 statement is contrary to the in-court trial testimony of said witness.
There is enough evidence to give rise that the verdict could be set aside and a new trial be held.
Witness #1 was called by the prosecutor and confronted with the crime scene statement made to the Police. Witness #1, under threat of perjury, admitted the crime scene statement that she did not witness the crime was the truth, her trial testimony false and indicated law enforcement officials threatened to send her to prison unless she testified that Derrick shot and killed Natanial Cash.
Despite the fact that police records and witness #1's own admission that she did not witness the crime, on July 12th, 1993 the judge sentenced Derrick to 25 years to life in prison!
Since the wrongful conviction, numerous witnesses have come forth to show Derrick is innocent.
